Jamshu was wrongly arrested by the police based only on his name
In an August night, Jamshu woke up from a deep sleep when he heard a knock on his door.
Rubbing his eyes and yawning, he opened the door. Before he could understand anything, a police team detained him.
Jamshu's son and wife were shocked at the arrest because they were not told the reason for it.
When they learnt that he had been arrested under a dowry case, Jamshu's son and brother-in-law rushed to the police to tell them that Jamshu is not involved in the case. The police did not listen to them.
Jamshu was wrongly arrested by the police based only on his name.
The main accused was Jamshu Mia, 37, of the same village, Udiapara, under Itna police station in Khishoreganj.
Jamshu Mia's wife Mansura filed a case in 2015 against her husband under the Dowry Prohibition Act. He was convicted and jailed for a year.
In 2016, Jamshu Mia was released on bail and went to Mauritius.
As the conviction warrant was pending when the Dhaka Metropolitan Magistrate court issued the arrest warrant on Jamshu Mia, the police went to arrest Jamshu Mia, but arrested another person named Jamshu instead, based on information given to them by a police source on August 7.
The next day, on August 8, a former union parishad chairman and an Awami League leader went to the police station and told them that Jamshu had been wrongly arrested.
But the police did not pay heed to them and sent Jamshu to Kishoreganj court, and the court sent him to jail. Jamshu has been languishing in jail for 34 days now.
Jamshu's lawyer Advocate Tanjir Siddque Riad pleaded at the Dhaka Metropolitan Magistrate court for Jamshu's release, and for an investigation into the matter of wrongful arrest.
Based on Jamshu's lawyer's plea, the court issued a show-cause letter to the Itna police station to verify Jamshu's identity on August 25.
Itna police in their investigation found that Assistant Sub-Inspector Abdul Halim had arrested the other Jamshu by mistake.
The Officer-in-Charge of Itna police station Morshed Jaman apologised for their mistake and applied for Jamshu's release.
On the hearing day on September 9, Jamshu's son Tusher brought Mansura Khatun, the complainant of the case, to confirm that the Jamshu who was arrested is not the convicted Jamshu.
Mansura revealed that this Jamshu is not her husband.
On September 9, Dhaka Metropolitan Magistrate Court led by Magistrate Millat Hossain issued a release order for Jamshu.
But Jamshu is still in jail. He will be released after the Kishoreganj court receives the release order and passes it to the Itna police station.
