Caretaker govt system will now be automatically added to constitution: Ahsanul Karim
The caretaker government system will now be automatically added to the constitution as today's High Court's verdict has revived the system, said constitutional expert and senior Supreme Court lawyer Ahsanul Karim.
"Since the High Court has declared the provision abolishing the caretaker government system void and has ruled to revive the system, the provision on caretaker government system will be automatically added to the constitution," Ahsanul told The Business Standard this evening.
He also said the High Court's rulings on other issues, including referendum, will also be automatically added to the constitution.
"After the Appellate Division's verdict on the Supreme Judicial Council earlier, the council was automatically revived. The same will happen in this case," he added.
Earlier in the day, the High Court scrapped a few sections of the 15th Amendment including those which abolished the caretaker government system stating that it is the will of the whole nation.
The High Court bench of Justice Farah Mahbub and Justice Debasish Roy gave the verdict after hearing two writ petitions filed in this regard.
Meanwhile, the writ petitioner's lawyer Sharif Bhuiyan told TBS that the review against the Appellate Division's verdict abolishing the caretaker government system in the 13th Amendment has not yet been resolved.
"As a result, it will not be possible to add it to the constitution yet. However, today's High Court's verdict has removed the major obstacle to the caretaker government system," he said.
He added that the articles on which the High Court has given a verdict, including the referendum provision, will be revived in the current constitution.
